Fly and Buy Program Terms and Conditions
Eligibility
The "Fly and Buy" program is available to Fraserway RV LP (“Fraserway RV”) customers (each, a “Purchaser”) who:
- purchase a new or pre-owned Vacation Certified Class A or Class C RV (an “Eligible RV”) from a Fraserway RV dealership (the “Fraserway RV Location”);
- are able to pick up the RV from the Fraserway RV Location within seven (7) days of their purchase of the Eligible RV;
- have a permanent address (“Permanent Address”) that is a minimum of 600 kilometers from the Fraserway RV Location;
- have notified their Fraserway RV sales representative that they wish to participate in the “Fly and Buy” program in advance of picking up the Eligible RV from the Fraserway RV Location; and
- are over the age of majority in the jurisdiction where the Fraserway RV Location is situated,
(a Purchaser meeting the criteria set out in this Section shall be referred to in these Terms as an “Eligible Purchaser”).
Reimbursement
Subject to all terms and conditions set out in these Terms, Fraserway RV will reimburse Eligible Purchasers who submit all required Documents (as set out in Section 5) for Eligible Travel Expenses (as defined in Section 3 below) up to a maximum aggregate amount of $2,000.00 CAD. For avoidance of doubt, any Eligible Travel Expenses above the aggregate amount of $2,000.00 CAD and any other expense incurred by the Eligible Purchaser (including any Dependent Expenses) shall not, in any circumstance, be reimbursed by Fraserway RV.
Eligible Travel Expenses
Subject to the maximum reimbursement amount set out in these Terms, Eligible Travel Expenses are limited to the following expenses incurred by the Eligible Purchaser, their partner, spouse and/or dependents:
- the cost of economy plane or train tickets for travel from the nearest airport or train station, as applicable, to where the Eligible Purchaser’s Permanent Address is located, traveling to the nearest airport or train station, as applicable, where the Fraserway RV Location is located, which travel must occur no more than 7 days prior to the Eligible Purchaser’s purchase of an Eligible RV from Fraserway RV and no later than date of the Eligible Purchaser’s pickup of such Eligible RV at the Fraserway RV Location;
- the cost of booking a hotel room, which hotel stay must begin no later than 7 days prior to the Eligible Purchaser’s purchase of an Eligible RV from Fraserway RV and 7 days after the Eligible Purchaser’s pickup of such Eligible RV at the Fraserway RV Location; and
- the cost of UBER, LYFT or taxi fares for the Eligible Purchaser’s transportation to/from the relevant departure and arrival airport/train station and to/from the Eligible Purchaser’s hotel stay in the region where Fraserway RV Location is located, which transportation must occur within the seven (7) day period between the Eligible Purchaser’s purchase of an Eligible RV from Fraserway RV and the Eligible Purchaser’s pickup of such Eligible RV at the Fraserway RV Location.
For avoidance of doubt, any expenses that are not Eligible Travel Expenses as specifically set out above are not eligible for reimbursement under the “Fly and Buy” program.
Limitations
This offer is limited to one reimbursement up to a maximum aggregate amount of $2,000.00 CAD per Eligible RV purchase from a Fraserway RV dealership and is non-transferable. The "Fly and Buy" program cannot be combined with any other offers, promotions, or discounts, nor can it be substituted for cash, credit, or any other offers.
Expenses of Partner, Spouse and Dependents
The Eligible Purchaser is entitled to include the Eligible Travel Expenses incurred by the Eligible Purchaser’s partner, spouse or dependents (“Dependent Expenses”) in such Eligible Purchaser’s Eligible Travel Expenses. For greater certainty, such Dependent Expenses shall be deemed to form part of the Eligible Purchaser’s aggregate Eligible Travel Expenses, and shall all be subject to the same qualifications described herein as the Eligible Purchaser’s Eligible Travel Expenses, including forming part of the Eligible Purchaser’s Eligible Travel Expenses for the purposes of the Limitations set out in Section 4, above. For illustrative purposes only, where the Eligible Purchaser’s Eligible Travel Expenses are $1500 and the Dependent Expenses are an additional $1500, only $2000 of such aggregate Eligible Travel Expenses shall be subject to Reimbursement under this "Fly and Buy" program.
Documentation
For reimbursement of any Eligible Expenses to be granted to the Eligible Purchaser, the Eligible Purchaser must provide to their sales consultant at the Fraserway RV Location each of the following documents either at the time of the Eligible Purchaser’s pickup, or within 14 days after the Eligible Purchaser’s pickup of their Eligible RV, as set out in section 7 hereof:
- the Eligible Purchaser’s valid government issued identification (“ID”) which remains effective and unexpired as at the date that such ID is presented to the Fraserway RV Location sales consultant (“Proof of Identification”);
- proof of the Eligible Purchasers Permanent Address which may be validated through presenting the Eligible Purchaser’s ID or a piece of mail dated within 3 months of the date of purchase of the Eligible RV addressed to the Eligible Purchaser at their Permanent Address from a banking or governmental institution (“Proof of Residence”); and
- true copies of the Eligible Purchaser’s travel expense receipts for any Eligible Travel Expenses as set out in Section 3 above (“Receipts”).
Failing to provide valid Proof of Identification or Proof of Residence shall result in no reimbursements being issued to the Eligible Purchaser, regardless of any Receipts provided. The Eligible Purchaser shall not be reimbursed for any expenses that such Eligible Purchaser has not provided Receipts for in compliance with Section 6(iii) above. The Fraserway RV sales consultant will keep a copy of these Documents on file. Any personal information contained in the Documents will be collected, used and disclosed in accordance with Fraserway RV’s Privacy Policy, located here (Privacy Policy | Fraserway RV), and by participating in the “Fly and Buy” program, an Eligible Purchaser consents to the collection, use and disclosure of their personal information in accordance with such policy.
Submission of Documentation
The Eligible Purchaser must submit their Proof of Identification and Proof of Residence Documents to their Fraserway RV sales consultant when placing their deposit on, or purchasing, the Eligible RV. All Receipts must be submitted to the Eligible Purchaser’s Fraserway RV sales consultant either at the time of the Eligible Purchaser’s pickup of the Eligible RV at the Fraserway RV Location, or within 14 days of such date. For avoidance of doubt, any Receipts submitted to the Fraserway RV Location sales consultant later than 14 days after the Eligible Purchaser’s pickup of their Eligible RV shall not be reimbursed by Fraserway RV.
Timing and Form of Reimbursement
Reimbursement will be issued to an Eligible Purchaser who meets all requirements for reimbursement set out in these Terms in the form of a cheque that is mailed to the Eligible Purchaser upon confirmation that all Receipts have been submitted by such Eligible Purchaser, and in any event no later than 60 days following the Eligible Purchaser’s pickup of the Eligible RV from the Fraserway RV Location. The cheque shall be addressed pursuant to instructions from the Eligible Purchaser provided to the Fraserway RV dealership at the time of the Eligible Purchaser’s pickup of their purchased Eligible RV from the Fraserway RV Location.
Bookings
Eligible Purchasers are responsible for booking their own flights, hotels, UBER, LYFT or taxis in connection with their travel from their Permanent Address to the Fraserway RV location.
Promotional Period
The “Fly and Buy” program shall be in effect between August 1st, 2024 at 12:00am PT to October 31st, 2024 at 11:59pm PT (the “Promotional Period”) and shall only apply to Eligible Expenses in connection with purchases of Eligible RVs made by Eligible Purchasers during the Promotional Period. Any purchases made by Eligible Purchasers outside of the Promotional Period shall not qualify for reimbursement under the “Fly and Buy” program.
Changes and Cancellations
Fraserway RV reserves the right to modify or cancel the "Fly and Buy" program at any time without prior notice. Changes to the “Fly and Buy” program will not apply to customers who have already booked flights, trains or hotels during the Promotional Period and have purchased an Eligible RV under the existing terms prior to the changes being made.
Retraction of Reimbursement Upon RV Return
Should the Eligible Purchaser return to Fraserway RV their purchased Eligible RV for refund after participating in the “Fly and Buy” program, any amounts reimbursed to such Eligible Purchaser by Fraserway RV pursuant to the “Fly and Buy” program shall be deducted from the refund credit due from Fraserway RV to the Eligible Purchaser. Nothing in this Section 12 is meant to provide the Eligible Purchaser with any rights to return or obtain any refund for their purchase of an Eligible RV.
Limitation of Liability
Fraserway RV will not be responsible for any damages, losses, costs or expenses of any kind, whether direct, indirect, incidental, special, exemplary, punitive, aggravated, or consequential, howsoever caused including, without limitation, travel disruptions, cancellations, fraud, misrepresentation or breach of these Terms by a Purchaser, lost, destroyed or incorrectly addressed cheques issued from Fraserway RV to Eligible Purchasers for reimbursement of Eligible Expenses or additional expenses incurred by customers participating in the "Fly and Buy" program. If, notwithstanding the limitations of liability noted herein, Fraserway RV is found to be liable for any damages, losses, costs or expenses in connection with the “Fly and Buy” program, in no case shall Fraserway RV’s total liability arising under any cause whatsoever including without limitation breach of contract, negligence or otherwise, be for more than the maximum reimbursement amount available under the “Fly and Buy” program, being an aggregate of $2,000.00 CAD.
Drive it Home Allowance
Upon the Eligible Purchaser’s purchase and pickup of the Eligible RV from the applicable Fraserway RV Location, as part of the “Fly and Buy” program, Fraserway RV will present the Eligible Purchaser with one fuel card holding a value of $1,000.00 CAD upon proper submission of the requisite Documentation outlined above in Sections 5 and 7. This fuel card may not be exchanged for cash or otherwise substituted.
Governing Law
These terms and conditions are governed by the laws of the province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
Acceptance
By participating in the "Fly and Buy" program, all Eligible Purchasers agree to and will comply with these Terms.
